These Terms and Conditions (“Terms”) govern the use of the online store available at https://melissa-24.pl (hereinafter referred to as the “Store”) and the sale of flowers and floristry services provided by MELISSA VIKTORIIA RANCHAKOVSKA (hereinafter referred to as the “Seller”, “we”, “us”).
By using the Store or placing an order, the Customer accepts these Terms. Failure to accept these Terms prevents the use of the Store.

2. Definitions
Customer – a natural or legal person placing an order in the Store.
Product – bouquets, floral arrangements, flower boxes, and other floristry products offered in the Store.
Personalized Product – a product made to the Customer’s individual order.
Sales Agreement – a distance contract concluded between the Customer and the Seller via the Store.
3. Use of the Store
3.1. The Customer undertakes to use the Store in accordance with applicable law.
3.2. Providing unlawful content or content infringing the rights of third parties is prohibited.
3.3. The Store is intended for adults only.
3.4. Persons under 18 years of age may use the Store only with the consent of a legal guardian.
4. Products and Offer
4.1. The Store offers fresh flowers, bouquets, and floral arrangements.
4.2. Product photos are for illustrative purposes only. Due to seasonality and flower availability, slight differences in appearance may occur while maintaining the style, color scheme, and value of the arrangement.
4.3. All floral products are handmade and created on an ongoing basis, which makes each product unique.
5. Placing Orders
5.1. Orders may be placed online 24 hours a day, 7 days a week.
5.2. Placing an order constitutes an offer to conclude a Sales Agreement.
5.3. The Seller reserves the right to refuse or cancel an order in the event of:
- lack of flower availability,
- pricing errors,
- technical issues,
- inability to contact the Customer,
- force majeure circumstances.
6. Prices and Payments
6.1. All prices are stated in Polish zloty (PLN) and include VAT, unless stated otherwise.
6.2. Available payment methods may include online payments, bank transfer, and cash or card on delivery (if available).
6.3. Orders are processed after payment has been confirmed.
7. Delivery
7.1. Delivery is available within Poland and selected European Union countries.
7.2. Delivery time depends on the Customer’s location and the selected delivery date.
7.3. The Seller is not responsible for delays caused by circumstances beyond its control, such as weather conditions or courier delays.
8. Right of Withdrawal
8.1. In accordance with Article 38(4) of the Polish Consumer Rights Act, the right of withdrawal does not apply to:
- perishable goods,
- fresh flowers,
- personalized or custom-made products.
8.2. Any quality-related complaints should be reported immediately upon delivery.
9. Complaints and Claims
9.1. Complaints may be submitted by email or by phone.
9.2. A complaint should include a description of the issue and photographic documentation.
9.3. Complaints will be reviewed within 14 days of receipt.
10. Personal Data Protection (GDPR)
10.1. Personal data is processed in accordance with applicable GDPR regulations.
10.2. Detailed information regarding personal data processing is available in the Privacy Policy published on the Store’s website.
11. Intellectual Property
11.1. All content, images, bouquet designs, and descriptions published in the Store constitute the intellectual property of the Seller and are protected by law.
11.2. Any use of such content without prior written consent of the Seller is prohibited.
12. Liability
12.1. The Seller shall not be liable for damage resulting from improper handling or storage of flowers after delivery.
13. Governing Law
13.1. These Terms are governed by the laws of the Republic of Poland.
13.2. Any disputes shall be resolved by the competent court having jurisdiction over the Seller’s registered office.
14. Amendments to the Terms
14.1. The Seller reserves the right to amend these Terms at any time.
14.2. The current version of the Terms is always available on the Store’s website.
